HOW WE WORK

How a Matter Is Conducted

STEP 01

Taking Instructions

The notice is construed, and the authority, the jurisdiction and the time limited for a reply are identified.

STEP 02

Settling the Brief

The record is reviewed centrally and the facts reduced to a chronology fit to be placed on a case file.

STEP 03

Instructing Local Counsel

An advocate enrolled and practising before the forum concerned is instructed on the brief as settled.

STEP 04

Attendance and Tendering

Counsel attends before the authority, tenders the representation and obtains a receiving.

STEP 05

Reporting and Closure

A written report follows each attendance and each filing until the matter is concluded.

Step 01: Taking Instructions

A preliminary assessment of the notice, of the authority from which it emanates, and of the period within which it must be answered.

CONDITION OF ENGAGEMENTSingle-Counsel Conduct

A Matter Is Conducted Through One Set of Representatives

Where two sets of representatives act on the same matter, inconsistent submissions are tendered to the same authority, legal professional privilege is put at risk, and a statement once made on the record is difficult to correct. Accordingly, a matter placed with Prosolicitors may not at the same time be routed through other agents or through parallel agencies. The condition governs the conduct of the engagement alone; it is not, and is not to be understood as, any representation as to the outcome of a matter.

ENGAGEMENT & PROCEDURE

Questions We Are Commonly Asked

On the conduct of a matter, the instruction of enrolled counsel, and the limits of what a solicitor may properly undertake.

We are instructed by business entities in banking, cybercrime and regulatory matters. In the ordinary course this comprises requisitions for records issued under Section 94 of the Bharatiya Nagarik Suraksha Sanhita, 2023; debit freezes and lien marks placed on operating accounts; notices and summons issued by State cybercrime units and by police stations in distant jurisdictions; inquiries touching the obligations of an intermediary under the Information Technology Act, 2000; and the continuing conduct of connected proceedings arising in more than one State. Whether a matter can be accepted is determined on its own facts, after the notice or requisition has been read and a conflict check completed.

A notice, requisition or account freeze requiring immediate attention?

The coordination desk will read the notice as received, identify the authority at whose instance it issues and the jurisdiction concerned, and set out the steps open to you. Correspondence is treated as confidential.
